Driving without a valid license in Arizona can get someone in trouble, depending on the circumstances of the situation. The following three different scenarios can occur when someone is caught driving without a valid license:

  • Firstly, if the driver holds a valid license, but didn’t have it with them at the time of the traffic stop, they can be charged with driving without a license. This refers to lack of proof, and usually leads to a traffic infraction in Arizona. The charge is dismissed once the person is able to prove that they possess a valid license. However, they may have to pay a small fine for the infraction.
  • Secondly, it could be the case where the driver never applied for a driver’s license, or their license was expired. According to the Arizona Revised Statutes § 28-3151, drivers are required to have a valid license in Arizona when driving a motor vehicle. The law is defined as follows: “Unless exempt pursuant to this chapter, a person shall not drive a motor vehicle or vehicle combination on a highway without a valid driver license and proper endorsement as prescribed by this chapter.”
  • Thirdly, it could refer to someone driving with a cancelled, revoked or suspended license. In such a case, the driver is found guilty of a Class 1 or a Class 2 misdemeanor. The driver may also face possible jail time. If the driver is arrested for a DUI while driving on a suspended license, they will be charged with a felony under A.R.S. § 28-1383. Moreover, a Class 1 Misdemeanor in Arizona carries a maximum penalty of a $2,500 fine and 6 months in jail.
