Interviewer: Once someone’s arrested and they are put inside a police car, will their license be taken away at that moment or not until later?
Brian Sloan: Under Arizona law, we have something called “the admin per se implied consent suspension.” That means if you are suspected of driving under the influence, just suspected, under Arizona law you have to provide a blood, breath or urine sample at the officer’s request.
If you consent, or at least do not refuse – but really, it has to be expressed consent – your license will be suspended for 90 days, if you are suspected of driving under the influence.
